POPLA (Parking on private land appeals update)

WHAT WAS THIS ABOUT

Combined Parking Solutions are pleased to confirm that their charges are accepted by POPLA (Parking on Private Land Appeals Service) as genuine charges for parking as opposed to penalties for breach of contract.

The vast majority of other parking companies issue charges to vehicles when they have breached a term or condition however Combined Parking Solutions were the first company to operate a contractual charging scheme as opposed to issuing penalties.

Our charges have long been confirmed by the courts as 100% enforceable and now the independent POPLA service also agrees.

The appeal as submitted by the appellant came directly from various internet forums who like to claim that every POPLA appeal they have ever assisted with has been successful and whilst this may be true for assistance with certain other parking companies it is certainly not true for all the appeals and court cases they have assisted for charges issued by Combined Parking Solutions – the fact remains they have a 100% failure rate as our charges are 100% enforceable.

The appeal was the standard being (1) no loss to the landowner (2) no right to enforce the charge (3) no grace period given – and as you can see from the transcript below ALL were refused as our charges are 100% enforceable and all contracts with our landowners give us total ability to issue charges.

Combined Parking Solutions would advise any person who is unsure about the legality of a charge issued to seek professional legal advice from a qualified solicitor and not from internet sites to which their contributors are sometimes economical with the truth when it doesn’t suit their agenda.

The next one we do not believe to be forum assisted but again shows that our charges are 100% enforceable + our contracts give us the right to issue and enforce them.
The second issue is that the driver claims the date was incorrect so in some way changed history and made the charge invalid – POPLA confirmed that the charge was still valid and payable by the driver.
